Auburndale Police Sergeant & Mother Both Found At Fault In Crash That Killed 5 Yr Old Girl

0

Polk County Sheriff’s Office Press Release

The Polk County Sheriff’s Office Traffic Unit has completed its investigation into a fatal crash that occurred on November 25, 2023, involving a marked Auburndale Police Department Chevrolet Silverado truck and a Kia Rio sedan at the intersection of US Hwy 92 (Magnolia Avenue) and Havendale Blvd. (S.R. 544).

The investigation showed that just before 10:00 p.m. that evening, Auburndale Police Officers were responding in emergency mode to a call for assistance from a Polk County Sheriff’s Office deputy who was engaged with a combative suspect on US 92 at Old Winter Haven Road. As APD Sergeant Danny Swan was heading eastbound on US Hwy 92 with his emergency equipment (lights and sirens) activated, he struck the Kia, which was occupied by Ms. Jermanica Anglin and her 5-year-old daughter, Jalina, in the intersection with Havendale Blvd. The traffic light at that intersection was red for traffic on US Hwy 92 at the time, and green for traffic on Havendale Blvd.

The patrol truck being driven by Swan was traveling at a high rate of speed as it approached the intersection, and was braking to slow down when the Kia entered into the intersection. The traffic control light for the patrol vehicle’s direction of travel turned steady red when the truck was approximately 500 feet from the stop bar for the intersection. The traffic control light for Ms. Anglin’s vehicle illuminated green and she proceeded northbound through the intersection. Ms. Anglin told investigators that she heard a siren, but thought it was far away. The other vehicles at the stop light did not proceed through the intersection prior to the crash occurring when the light illuminated green.

Upon impact, the patrol vehicle was traveling at approximately 68 miles per hour. Five seconds prior to the crash, the truck’s speed was 105 miles per hour. The Kia’s impact speed was approximately 22 miles per hour. The police truck’s front passenger side impacted the front driver side of the Kia. The angle of the collision caused intrusion into the engine compartment of the Kia in a direction from the front driver side corner toward the passenger side front wheel.

Ms. Anglin was wearing a seatbelt. 5-year-old Jalina was seated in the backseat wearing a seatbelt. The child was not seated in a booster seat or approved child restraint device, as is required by state statute. Polk County Fire and Rescue transported Ms. Anglin to Winter Haven Hospital with injuries. Jalina was transported to Winter Haven Hospital, where she was declared deceased.

Following the impact, the police truck was redirected to the northeast across the median strip of U.S. Highway 92. The Kia was redirected backwards in a southeasterly direction toward S.R. 544 (Havendale Blvd.).

Based on the facts and evidence gathered through the investigation, there is probable cause to believe that Sergeant Danny Swan and Ms. Jermanica Anglin violated the following Florida State Statutes:

Sergeant Danny Swan:

316.183 (1) – Unlawful speed – No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. In every event, speed shall be controlled as may be necessary to avoid colliding with any person, vehicle, or other conveyance or object on or entering the highway in compliance with legal requirements and the duty of all persons to use due care.

Ms. Jermanica Anglin:

316.613 (1)(a) – child restraint requirement – Every operator of a motor vehicle as defined in this section, while transporting a child in a motor vehicle operated on the roadways, streets, or highways of this state, shall, if the child is 5 years of age or younger, provide for protection of the child by properly using a crash-tested, federally approved child restraint device.

1. For children aged through 3 years, such restraint device must be a separate carrier or a vehicle manufacturer’s integrated child seat.

2. For children aged 4 through 5 years, a separate carrier, an integrated child seat, or a child booster seat may be used. However, the requirement to use a child restraint device under this subparagraph does not apply when a safety belt is used as required in s. 316.614(4)(a) and the child:

a. Is being transported gratuitously by an operator who is not a member of the child’s immediate family;

b. Is being transported in a medical emergency situation involving the child; or

c. Has a medical condition that necessitates an exception as evidenced by appropriate documentation from a health care professional.

316.126(1)(a) – Failure to yield to approaching emergency vehicle with lights/siren activated – Upon the immediate approach of an authorized emergency vehicle, while en-route to meet an existing emergency, the driver of every other vehicle shall, when such emergency vehicle is giving audible signals by siren, exhaust whistle, or other adequate device, or visible signals by the use of displayed blue or red lights, yield the right-of-way to the emergency vehicle and shall immediately proceed to a position parallel to, and as close as reasonable to the closest edge of the curb of the roadway, clear of any intersection and shall stop and remain in position until the authorized emergency vehicle has passed, unless otherwise directed by a law enforcement officer.

The totality of the factors described in the report resulted in and/or contributed to the death of Jalina Anglin. Polk County Sheriff’s Office deputies issued the “unlawful speed” citation (No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.) to Sgt. Swan on Thursday, March 7th. No citation is being issued to Ms. Anglin considering the tragic result of the crash.

Statement by Auburndale Police Chief Terry Storie:

“This was a terrible, tragic accident. My heart goes out to Ms. Anglin and the loss she and her family have experienced from the death of Jalina. On behalf of our whole department and our city, I offer my sincere sympathies and prayers to the family and all those affected. When this crash occurred, I asked that an independent investigation be conducted by the Polk County Sheriff’s Office, and those facts and results are now available.

Based on the completed crash investigation, Auburndale Police Sergeant Danny Swan has received a civil citation for unlawful speed (FSS 316.183 (1)).

The PCSO decided not to issue citations to Ms. Anglin based on their investigative findings because of the tragic loss of her daughter. I agree with this decision.

Now that the crash investigation has been completed, I can acknowledge per Florida Statute 112.533(4) that the Auburndale Police Department is conducting an internal investigation related the crash. Specifically, we are investigating (1) the allegation of unlawful speed and (2) the allegation of a violation of our policy regarding operating a police vehicle during an emergency response.

I cannot pre-judge the outcome of this investigation, nor discuss disciplinary decisions until that review is completed. We will use the facts and findings from the PCSO report as a part of the internal investigation. Sergeant Danny Swan has been assigned to administrative, non-patrol duties since the crash. This administrative assignment will continue pending the outcome of the internal investigation.” Terry Storie, Chief of Police, Auburndale

Brevard County Registered Sex Offender Busted In Polk County – Accused Of Trying To Kidnap 9 Yr Old Girl

Polk County Sheriff’s Office Press Release

“On March 6, 2024, Robert Miranda of Titusville, DOB 3/6/1982, was booked into the Polk County Jail on his 42nd birthday for multiple felonies related to his lewd and lascivious behavior during the end of February in the Winter Haven area. Miranda is a registered sex offender in the state of Florida. The investigation was conducted by the Winter Haven Police Department, and the PCSO, due to the incidents being reported within the city and in unincorporated areas of the county.

During the last week of February 2024, the Winter Haven Police Department and the Polk County Sheriff’s Office received reports of a suspicious man driving a grey midsized SUV in the Winter Haven area, approaching children who were walking to their bus stops in the morning. At 7:20 a.m. on February, 23rd, a 9-year-old child reported that while she was walking to her school bus stop on Avenue H and 15th St NE, the man, wearing a black surgical style mask, pulled up and asked her if she was missing a dog, and said he had one in his vehicle. Recognizing that he was trying to get her in the car, she ran to an adult and reported it. The man drove away, and the child noticed that the vehicle did not have a tag on it.

Twenty minutes later, at 7:40 a.m., a 12-year-old child reported a male matching the same description approached him while he (the child) was walking to his school bus stop at Avenue J and 4th St SE. The driver opened his door and masturbated in front of the boy. The boy took out his phone and attempted to take a photo, at which point the driver immediately drove in reverse and fled. He told officers that the man was wearing a black surgical style mask.

The description of the driver and vehicle given by both kids matched – they described a skinny white or Hispanic male in his 20s or 30s with short brown or black hair wearing a black medical style mask over his mouth and nose, driving a grey mid-sized SUV.

Video surveillance collected from businesses in the area showed the following between 7:50 and 8:00 a.m. that day:

·        A grey Mitsubishi Outlander driving backwards into a parking lot of a business on Avenue K SE; The driver backed into a parking space and after a short amount of time, he got out and walked to the rear of the SUV. He was wearing a black shirt and black pants. This matches the statement given by the 12-year-old child of the suspect fleeing in reverse.

·        The Mitsubishi Outlander traveling towards 3rd Street

·        The Mitsubishi Outlander passing a school bus on 3rd Street

Winter Haven investigators obtained additional video from 3rd Street which showed the license plate of the SUV. They ran the tag, and found it was registered to Christina Miranda of Haines City.

Click here to see video of Robert Miranda before, during, and after some of the crimes.

During the investigation, another incident was found to have occurred on February 16, 2024, where two women were approached by the same suspect in the same vehicle on Avenue A SW. He opened the driver’s door and masturbated in front of them. When the victims yelled at the driver, he left. Video surveillance from the area captured the incident. The victims reported he was wearing a black surgical style mask, and that the vehicle did not have a tag.

Detectives responded to Christina Miranda’s home in Haines City, and learned that her adult son Robert has been living in Lake Alfred and driving the Outlander. She told detectives that she purchased it for him to drive, and he is insured; she provided the insurance documents.

Miranda has been a registered sex offender since 2005 due to a conviction in Brevard County for lewd and lascivious battery on a victim between 12-15 years old. He has registered two vehicles with the state per the FDLE requirements – a red Suzuki motorcycle and a red Alfa Romero, and his Titusville address.

PCSO Special Victims Response Team Detectives obtained a warrant for his arrest for the failure to register offenses related to his temporary Polk County address and possession of the Outlander. He was taken into custody in Titusville by the Brevard County Sheriff’s Office. PCSO Special Victims Unit detectives obtained a search warrant for his residence and the Outlander, and seized the following: his cell phone, several articles of clothing, and three black masks. They then obtained an additional warrant charging him with sex crimes.

“The real heroes of this investigation are the very brave children who immediately thwarted this pervert’s efforts to corrupt, assault, kidnap or molest them, and who gave law enforcement officers excellent descriptions of the suspect and the vehicle he was in. Secondly, I would like to commend my deputies and detectives for relentlessly pursuing and following up on every lead from here to Brevard County, resulting in the swift apprehension of a registered sex offender who clearly is on a mission to continue to assault and abuse children.” – Grady Judd, Sheriff

“The joint investigation conducted between PCSO and Winter Haven clearly shows the outstanding dedication to get this offender off the street and put where he belongs. From the very beginning, our agencies left no stone unturned to come to this successful outcome,” – Winter Haven Deputy Police Chief Vance Monroe

On March 6, 2024, Miranda was transferred to the Polk County Jail. He is charged with:

  • Three counts sex offender failure to register (F3) – for failing to report his temporary residence in Lake Alfred to the PCSO; for failing to report the Lake Alfred residence to the DHSMV; and for failing to report the Mitsubishi Outlander as a vehicle he owns and drives.

  • One count indecent exposure (F3)* – for exposing himself to two women on February 16, 2024.

*these charges were all enhanced due to the suspect wearing a mask during the commission of the crimes

Robert Miranda has an extensive criminal history:

·        February 1997 – Orange County Sheriff’s Office – Arson (guilty)

·        January 2000 – West Melbourne PD – Sex offense against a child (adjudication withheld)

“These cannot be the only instances where Miranda has solicited or exposed himself—we encourage anyone who has seen this guy and/or car connected with anything illegal to please contact us. We need to make sure this guy spends years in prison to separate him from innocent children.” -Grady Judd, Sheriff”

Bartow Man Charged With Aggravated Manslaughter After Allegedly Beating His 4 Month Old Daughter To Death

A joint death investigation between the Polk County Sheriff’s Office and Bartow Police Department that began on Thursday, February 22, 2024, resulted in the arrest of 22-year old Jacob Kubai for causing the death of his infant daughter, Willow “Strawberry” Kubai.

Kubai was arrested on March 5, 2024 and charged at the PCSO’s Sheriff’s Processing Center with: Aggravated Manslaughter of a Child (F1), Aggravated Child Abuse (F1), and Knowingly Abusing a Child without Bodily Harm (F3, 2-counts).

Bartow detectives started the investigation after 4-month old Willow Kubai was brought in to Bartow Regional Medical Center with no brain activity and suspicious physical injuries.

Willow was transported by helicopter to Saint Joseph’s Hospital in Tampa and it was then determined that she had a fractured skull, multiple layers of hemorrhaging to the brain, bruises, scratches, and broken ribs.

“Death investigations can often take many months before they are complete. In this case, the injuries to this beautiful baby girl were so severe that it left no doubt how she was killed. I don’t know how a father could do this to his child, but I do know he should be locked-up for as long as the law allows.” – Grady Judd, Sheriff.

A PCSO detective conducted separate interviews with Jacob and his wife Rebekah, and neither was able to explain how Willow got her injuries.

During the investigation, Jacob recounted his day with Willow, prior to her arriving at the hospital. He told the detective that she was fine when the two of them were at a local store between 6:40 pm and 7:50 pm.

After returning home, Jacob said he fed the baby, and then went to check on her at around 8:10 pm and discovered she was not breathing.

Security video from the store that was obtained by PCSO detectives showed Jacob at a self-checkout register at 6:54 pm, but the victim was not seen in the video.

When confronted with the inconsistency, Jacob refused to provide any additional information.

A February 27th autopsy performed on the victim by the District 10 Medical Examiner’s Office revealed multiple blunt force trauma injuries to the front of the baby’s head, a swollen and hemorrhaged spine, and an acute skull fracture on the back of the head. There were also ten rib fractures that were in the healing stage.

In the arrest affidavit, the autopsy conclusion states, “Based on the injuries noted, the skull fracture would have been caused by the caregiver at that time. The cause of death was determined to be blunt force trauma of the head. The manner of death was ruled as a homicide.”

The injuries occurred while Rebekah was at work, while Jacob was the sole caregiver of the victim for three hours prior to being taken to the hospital.

It was also learned that on at least two occasions (January 17th and February 22nd), Jacob left the baby alone with no caregiver.

“Bartow Police Department is thankful for our partnership with the Polk County Sheriff’s Office Special Victims Investigations Unit in this investigation.“ –Chief Andy Ray, Bartow P.D.

Two Teenager Brothers Busted Allegedly Preparing To Burglarize PCSO Undercover Location

0

The Polk County Sheriff’s Office is currently holding a press conference on a prostitution and human trafficking investigation with over 250 arrests! During the sting two brother reportedly showed up looking like they were ready to rob the undercover house where the sting was occurring. Here is the initial information from PCSO:

Two brothers, ages 16 and 17 years old, came to the location armed with a BB gun, wearing hoodies and ski masks, and creeping around the undercover location as if they were about to commit an armed robbery of the undercover detective who was posing as a prostitute whom they solicited online.

Omar and Kalem Najjar were both charged with attempted armed robbery, a felony, as well as loitering/prowling.

“During these types of undercover investigations, I can truly say that we have ‘seen it all’ and yet we are still surprised by some of the violent acts we encounter. These two teenagers were incredibly lucky that they did not brandish a firearm while stalking who they thought was a prostitute, at a location filled with law enforcement officers. This could have ended very badly for them. This should also illustrate just how dangerous it is to agree to have sex with someone in exchange for money – there were 13 other suspects who brought firearms to the location.” – Grady Judd, Sheriff

J.C. Reviews: Dune Part 1 is an Interesting Slowburn of a First Part

by James Coulter

Frank Herbert’s 1965 sci-fi epic Dune has long been considered an unfilmable story due to its grandiose length and scale. Then again, the same was said of Lord of the Rings, which is roughly the same length. So, if Lord of the Rings could be successfully adapted, why not Dune?

That question has been asked many times before, as attempts have been made before to bring Dune to screens big and small. David Lynch famously filmed his theatrical adaptation in 1984, which, while now a cult classic, was then a financial and critical flop. The SyFy Channel attempted another adaptation with a mini-series in 2000.

Now, nearly 20 years later, acclaimed film director Denis Villeneuve has taken up the challenge to bring Dune to the big screen with a multi-part film series. Part 2 was recently released in theaters. But what about the first part? Did Part 1 justify creating a Part 2? Or should the first movie have been left in the desert to be eaten by sand worms?

Young Willy Wonka* is the heir apparent to a royal house. His family has been sent to Space Iraq to oversee the mining of Space LSD. However, it turns out they were sent there as a trap so that the other royal family, led by Drax the Destroyer, could kill them and take over. Now, Young Willy Wonka, along with the help of his companions, Aquaman and Thanos, must go on a journey to avenge his father.

Complicating matters is that Young Willy Wonka is seen as the Space Messiah by the native inhabitants of Space Iraq. The reason being his mother is part of a line of Space Nuns who are prophesized to bring about the birth of the Space Messiah. As such, he has special powers, including clairvoyant dream that give him visions of MJ from Spider-Man, who may or may not be tied to his destiny. Can Wonka avenge his family while avoiding a Space Holy War in the process? (Also, the giant butthole worms that live on that planet?)

Dune is a story set in a fantastical sci-fi setting that is simultaneously otherworldly yet familiar. For example, on the desert planet which the main story takes place, people wear special suits that keeps them hydrated them by recycling their bodily fluids, and they fly in gyrocopters that look and fly like dragonflies. However, the overall setting looks and feels like the Middle East. (Hence the glib remark about it being Space Iraq!)

Far from being yet another sci-fi action thriller, Dune is more like Star Wars meets Game of Thrones with a heavier focus on political struggle and infighting, as multiple factions vie for control over a planet and its precious resources. In fact, while the setting is otherworldly, the subtext remains rather on the nose about this world’s politics. After all, the story takes place in a desert setting whose people and resources are exploited by an imperialist empire for the sake of profit. (Sadly, not much about the Middle East has changed since Frank Herbert’s original story that it remains pertinently relevant today!)

Cinematically, the first movie is a visual marvel with grandiose thematic settings and which weaves an intricate web of lore and backstory to develop a fleshed-out world filled with intriguing characters all with their own unique motivations. Unfortunately, the entire movie is a

real slowburn with mostly consists of all setup and no real payoff–well, that is, until the next movie, that is.

How can I best describe this movie? Imagine you’re in a D&D session. Your DM spends an hour and a half explaining in excruciating detail the backstory of your game’s settings, its characters, and the overall objective of your campaign moving forward. Then, right when you finally expect to start playing the game, they announce, “Okay, come back next week and we’ll actually play the game this time.”

That’s how watching this movie feels!

Dune: Part 1 spends most of its time setting up the story, and takes most of its time doing so that what little plot moves at a snails pace without much else happening. Some people could compare this movie to Fellowship of the Ring, but, really, it feels more like if that movie consisted of the first act stretched out to the same three-jour runtime and ending with Frodo leaving the Shire. All set up, no pay off, and blatantly telling you to come back next time for the rest of the story which promises to be more interesting.

So, yeah, Dune: Part 1 is a good prologue to what will hopefully be a better, more interesting movie. Let’s hope Part 2 lives up to the hype this movie gave it.

*Yes, I know these characters have real names, but it’s funnier to refer to them by the other characters that their actors have played.
