During interviews with friends of Blue’s who were with him at the Uprising Bar, they stated he was walking towards the rear of the bar when he suddenly fell.  When he fell, Blue injured his chin.  Blue also appeared to have an ear injury at the time of the fall.  One of Blue’s friends drove him to Lake Wales Medical Center to be checked.  While at the bar, Blue was reportedly never in any altercations or fights with anyone.

Deputies responded to the Uprising Bar and made contact with several employees closing up.  The employees stated there were no altercations at the bar during the event they had.  They also reported never hearing any shots fired and did not see anyone appearing to be injured.  After explaining the situation to the employees, the interior of the bar was searched.  All remaining patrons were cleared from the bar and it was secured.  The exterior of the bar was secured with crime scene tape – the investigation is ongoing.

breakingnewshooting

Lakeland , Florida – At 6:02 p.m. this evening, Thursday, November 10, 2016, PCSO was dispatched to 2938 Del Rose Drive North in Lakeland in response to a family disturbance.

The reportee, 75-year-old Marjorie Pacuicrk (pronounced Pa-Churrick), said she wanted help getting her adult son out of the house. The dispatcher told her to walk outside and wait for the deputies to arrive.

The deputies arrived on-scene and met with Marjorie in the front yard. She told them that she had asked her son, 53-year-old John Pacuicrk, to help her push her car into the backyard. He got angry but said he would help. He tried, but it wouldn’t move. He became very angry and went inside the house. She followed him inside, and he went into his bedroom and locked the door. She told him through the locked door that she wanted him to leave. She then decided to call PCSO, due to his state of anger and refusal to talk to her.

When the deputies spoke with Marjorie in the front yard, she told them that he was locked inside his bedroom and that he has a gun in his room.

The deputies went inside to find John and talk to him. While inside, they heard gunshots coming from the front yard – they ran outside and saw two men fighting, rolling on the ground (John and his 51-year-old brother Theodore). They saw one of the men had a gun in his hand and they gave him commands to drop the weapon. Theodore, who was not armed, jumped up. John then jumped up and pointed the gun at Deputy Lee Smith. Both deputies (Lee Smith and Bernardo Del Valle) shot John – he was struck several times.

The deputies advised on the radio shots were fired and they asked for EMS to respond. They performed life-saving measures on John until EMS arrived. He was pronounced dead on-scene.

Deputies located Marjorie in a car in the front yard with two gunshot wounds – one in each lower leg. She was transported to the hospital and is in stable condition.

So far during preliminary interviews, deputies have learned the following: Theodore told deputies that after they went inside the house, he was outside and heard the chain link fence rattling. He walked around the side of the house and sees John, who walks past him and goes into the front yard. He had gone outside the back door of the home, jumped the fence, and was walking around to the front yard. Theodore sees John has a gun in each hand and is saying, “I’m going to kill her.” He puts John in a bear hug. While Theodore is holding onto John, John shoots their mother multiple times – she is struck twice, once in each lower leg. They wrestle and fall on the ground, fighting – that’s when the deputies come outside.

Marjorie managed to get into her car and seek refuge after being shot.

The two guns John was armed with are on the scene.

The deputies involved are:

23-year-old Lee Smith
28-year-old Bernardo Del Valle

They were both hired in January 2015 and are both assigned to Southwest District patrol. Per standard PCSO protocol, both deputies have been placed on paid administrative leave.

John has a previous DUI arrest in S.C. in 1986 – his Florida D.L. was revoked based on that. I do not have a photo of him.

Per normal protocol, there are four independent investigations ongoing at this time:  A death investigation; a PCSO Administrative Investigation; an investigation by the State Attorney’s Office; and a Medical Examiner’s Office examination.

david-flores

Winter Haven, Florida – According to an arrest affidavit by the Polk County Sheriff’s Office a fight between roommates became ultra violent. On 11/06/2016 the victim, Sergio Diaz, invited a friend, Ana Peachey, to his residence for dinner, 135 Akron Ave., Winter Haven. According to reports Diaz’s roommate, David Flores, entered the residence and became enraged. After a verbal argument Flores allegedly started to strike Diaz multiple times with a metal pipe. The blows allegedly caused gashing on the scalp, face, back and arms of Diaz. Flores then allegedly produced a knife and attempted to stab Diaz. Diaz allegedly tried to defend himself with a mop handle and then grabbed the knife blade with his bare hands. According to deputies cuts on Diaz hands support his claim.

During an interview with Flores he advised that Diaz pulled a gun on him and he knocked the gun from his hands and was defending himself. A signed consent to search the residence was obtained. A searched of the residence found a gun under a dresser in a locked bedroom. The gun was not loaded. Flores had no explanation as to how the gun would have ended up in a locked bedroom under a dresser. Also if Diaz would have stashed the gun in that location, how would he have been able to do so without getting blood anywhere on the gun, floor or door of the bedroom. No blood was found in the bedroom and Diaz was bleeding profusely from multiple gash wounds.

According to reports Ana Peachey fled the residence as the two men started to argue and fight. She did not see exactly what transpired.

Flores was arrested for 2nd Degree Murder and bail was set at $100,000.00

Ares Attempted MURDER

The victim, Daniel Ares, advised deputies that at approximately 11pm on May 19, 2016 he allegedly started communicating with three known associates to go and buy some cocaine. The three associates,Timothy Rivera Rosado, Anthony Louis Rivera Rosado, and Jeremy Stuart Vilella were known to buy “weed” from him weekly. In the early morning hours of May 20, 2016 the three suspects allegedly picked Ares up in Timothy Rivera Rosado’s mothers car to buy the cocaine. After driving for an extended period of time, they ended up in an abandoned area of Poinciana, FL. According to the arrest affidavit, Ares, advised the suspects told him they were meeting their “cocaine plug” there, however he never observed anyone besides the three people in the vehicle with him. Ares advised he was sitting in the rear driver’s side seat of the vehicle and exited when they stopped, as they planned to smoke a blunt. He stated when he began to stretch and walk from the vehicle he was shot from behind. He fell to the ground, and heard multiple gun shots. Ares advised deputies that Anthony Rivera Rosado allegedly came to him and told him he was tired of being disrespected. A substance was then poured on him, which he believed was gasoline, and then he was lit on fire.

At this point it is appears the suspects left Ares for dead. Ares was able to extinguish himself and contacted law enforcement. According to the affidavit at no time did anyone of the three suspects offer him assistance, contact law enforcement or medical services. Ares could not advise who specifically shot him and poured the gasoline on him.
Ares was located bloody in the roadway of Hemlock Ave at Dogfish Road, Poinciana, FL 34759 which is a remote location with sand dunes on either side of a two lane road with no residences or buildings within sight. Ares was flown by helicopter to Orlando Regional Medical Center to be treated for three gunshot wounds and second and third degree burns to approximately thirty percent of his body.

At the scene Polk County Sheriff’s Deputies found five shell casings, a cannabis cigarette, US currency, the victim’s clothes and shoes, and other items of evidence were obtained, consistent with Ares’ statement. It appeared that no money or property was removed from Ares’ person or clothing. The Fire Marshall responded to the scene. His K-9 partner detected to the odor of accelerants on the clothing left at the scene, which were collected for further testing.

The three suspects are currently in Polk County Jail with a $30,000 bond each. They have been charged with Attempted First Degree Murder & Conspiracy To Commit First Degree Murder.
