Lake Wales Man Killed When Truck Flips Into Water Filled Ditch

Lake Wales, Florida – Around 7:00 p.m., 71-year-old Isidro Medina of Camp Mack Road in Lake Wales, had just finished fishing with his nephew, 12-year-old Alberto Reyes of Garner Avenue in Lake Wales, on the North end of the Resmondo Sod Farm (where Medina works and lives), and the pair left in Medina’s Dodge Ram pickup truck. Medina was driving outh on a dirt road when the truck apparently hit a mud puddle, forcing the truck off the dirt road, where it rolled upside down into the water-filled ditch. 12-year-old Alfredo was able to escape from the truck out of an open window, and attempted to get Medina out of the truck, to no avail.  The boy ran across the farm (approximately 2 miles) to get help. I do not have the names of the witnesses who went back to the scene with Alberto, but they helped extricate Medina, and called 9-1-1, and called Alberto’s mother. EMS arrived on-scene where they attempted to revive Medina. He was transported to Lake Wales Hospital, where he was pronounced deceased. The investigation is ongoing but no charges are pending. It is likely Medina succumbed to drowning and not crash-related injuries.

 

2 People Killed  4 Others Hospitalized In Thornhill Rd. Accident

Auburndale, Florida – Around 2:15 a.m. this morning (Sunday, August 7, 2016) a white 1999 Ford F-250 Extended Cab pickup truck with six adult occupants was traveling north on Thornhill Road when it entered into the curve just north of Sugar Creek Drive in Auburndale. After exiting the curved portion of the road, the driver lost control of the truck, overcorrected, and the truck overturned, striking a culvert and causing the truck to flip several times. Three passengers were ejected during the roll. The occupants and their injuries/fatalities are as follows:
Driver: 24-year-old Kenneth McIntosh,  Cypress Trails Drive, Polk City; in critical condition at LRHMC

Front middle passenger: 32-year-old Wesley Workman, Betty Ann Drive, Auburndale; ejected from the truck, deceased

Front right passenger: 30-year-old Bradley Jones,  Teri Street, Auburndale; in stable condition at LRHMC

Rear driver side passenger: 42-year-old Lewis Strickland, Ellie Road, Auburndale; ejected from the truck, deceased

Rear middle passenger: 28-year-old Roy Gainey, Winter Ridge Drive, Auburndale; in stable condition at LRHMC

Rear passenger side passenger: 29-year-old Robert Cushing, Valencia Street, Winter Haven; ejected from the truck, in stable condition at LRHMC

None of the occupants were wearing seatbelts. Speed and impairment may be factors. The investigation is ongoing. It does not appear that any other vehicles were involved.

When Lakeland resident Bob Broyles accidentally fell into a creek near his home, City of Lakeland Employee Ed White and Genaro Rivera*, a Contractor with the City of Lakeland, were at the right place at just the right time to help Mr. Broyles! Broyles said he was out feeding turtles when he fell in. Police & fire crews showed up, but Broyles refused care. The incident occurred last week.

*Unfortunately, Mr.Rivera was not available for the filming of this clip, but Mr. Broyles was extremely thankful nonetheless!

 

Lake Wales Convicted Murderer To Be Released On Bail Today Following Appeals Court Ruling

Bartow, Florida – According to published reports a three-judge panel at the Lakeland-based 2nd District Court of Appeal ruled 2-1 that Dion Kaseta, Lake Wales, deserves a new trial. Kaseta was accused of murdering a Lake Wales woman named Kimberly Bumbaloagh Mimmovich in 2001.

A judge, Judge Stevan Northcutt, sighted that the original court had erred in allowing hearsay testimony into trial (the complete ruling can be read HERE). Another judge ruled that Kaseta was able to be released on bail ($50,000) pending a new trial.

The Story: Mimmovich was reportedly last seen in Deerfield Beach, Florida at appoximately 6:00 a.m. on December 9, 2001. She had left her mother’s home to attend a birthday party in Auburndale. Afterwards she apparently went to Deerfield Beach with her live-in boyfriend of four months, Dion Kaseta. He claims Mimmovich wanted to watch the sunrise and he dropped her off at the beach. Kaseta’s sister’s house was located at Deerfield Beach, which is on the ocean and four miles from Mimmovich’s residence in Lake Wales, but Mimmovich was not familiar with the Deerfield Beach area and has no friends or relatives living there. Kaseta says she told him she was going for a walk alone, left, and never returned. She was carrying a black leather notebook containing her identification, an unspecified amount of money, a cellular phone, pair of shorts, and a swimsuit and a pair of shorts wrapped in a white beach towel at the time she went missing.

At Kaseta’s November 2012 trial, all agreed that late on the evening of December 8, 2001, he drove from the couple’s mobile home in Polk County to the home of his sister and brother-in-law in Deerfield Beach, on Florida’s southeast coast, arriving early on the morning of December 9. In interviews with law enforcement at the time and two years later Kaseta recounted that he and Mimmovich made the trip together. Kaseta said that the two had decided on impulse to go to the beach. They considered driving north to Daytona Beach but settled on Deerfield Beach to the south so that Mimmovich could meet Kaseta’s family.

According to Kaseta, he and Mimmovich drove overnight and arrived the next morning too early to disturb his relatives. Their house was several blocks from the Atlantic Ocean, and Mimmovich wanted to wait on the beach to see the sunrise. Kaseta dropped her there, watched her walk toward the beach on the catwalk that extended over the dune line, and drove to his sister’s house to wait outside until an acceptable time to waken the household. He never saw Mimmovich again. He does not know her whereabouts or whether she is alive or dead.

The State’s theory was simple and straightforward: on the evening in question Kaseta killed Mimmovich during an altercation in their mobile home, then disposed of her body somewhere along his route to Deerfield Beach. But the evidence to support that scenario was meager. The State’s proof was entirely circumstantial and none of it was forensic; luminol-assisted examinations of the couple’s mobile home, Kaseta’s car, and a boat he used to go fishing in Deerfield Beach failed to turn up blood or any other indicia of mayhem.

We will continue to follow this story as the new trial date is set for sometime next year.

Auburndale Woman Convicted Of Trafficking 5 Kilograms Of Methamphetamine

Crystal CaldwellBartow, Florida – Five kilograms of methamphetamine were entered as evidence in a two-day trial where jurors found Crystal Caldwell guilty of trafficking.

Caldwell, 34, of Auburndale, faces a minimum of 15 years in prison after the jury convicted her Thursday of trafficking 200 or more grams of amphetamine, possession of drug paraphernalia, possession of a structure used for trafficking, sale or manufacture of controlled substances and resisting officers without violence.
Assistant State Attorney Jacob Orr told the jury Wednesday that undercover Polk County Sheriff’s Office detectives went to Caldwell’s house to buy two kilos of meth for $20,000. After the transaction, the property was searched, and three more kilos of meth were recovered from a wheel inside a truck in Caldwell’s yard.
Law enforcement conducted a search, and in addition to the five kilos of meth, a small plastic bag of meth was found in Caldwell’s pocket.

While two other men were the ones who handed the drugs to undercover deputies, Orr pointed out to the jury that the drugs were at Caldwell’s house and that she was their link.

Seven witnesses testified, including one of the men who helped Caldwell sell the drugs, and the jury was presented with audio and video evidence Wednesday that she was a key player in the drug transaction.
Caldwell’s attorney argued that Orr hadn’t proved anything through the testimony and evidence, but Orr responded in closing statements saying that without Caldwell the drug deal “simply would not have happened.”
He told the jurors he was confident they would determine he’d proven the case beyond a reasonable doubt because the evidence proved Caldwell was guilty beyond a reasonable doubt.

“This was all happening at Crystal Caldwell’s house. The drugs were at her house,” Orr said. “You could debate what role she played, but you cannot deny she played a role.”

After reviewing the audio and video evidence again, the jury deliberated for about an hour and a half. They determined Caldwell was guilty as charged, and she will be sentenced in September.
