Two Suspects Arrested in the Murder Homicide of Preston Burnett

Homicide suspect James Garst will have his first appearance hearing tomorrow, Saturday, May 27th. The weekend hearings start at 8:00 a.m.

According to their affidavits and previously released information, on May 10, 2017, Preston Burnett’s body was found by a man out walking near the woods on Skyview Blvd in Lakeland. Preston had been shot to death, according to the autopsy. Preston was last seen on Teri Street in Auburndale, where he was taken by an Auburndale Police Corporal after being seen sleeping on a bench in downtown Auburndale.

Preston was killed between 3:15 and 3:30 p.m. on May 10, 2017, in the location where he was found (near the dead end of Skyview Blvd). The area serves as a cut-through that connects Skyview Blvd to the Secret Cove subdivision.

PCSO released photos that were found at the scene, of two unknown women. The women were positively identified as Julie Roderus and her mother. Julie was in jail at the time. Detectives interviewed her and were able to identify her boyfriend, Jamie “Jamo” Garst, who drives a gray Buick.

A gray Buick was seen on video surveillance heading northbound on Skyview Blvd on the day of the homicide. It never exited back out the way it came, leading detectives to believe it traveled on the “cut-through” path out of Secret Cove.

On May 25, 2017, a PCSO deputy sheriff conducted a traffic stop on Garst’s Buick. Post-Miranda, he told them the following:

  • He was at his residence, 447 Skyline Drive in Lakeland on May 10th when Chris Clardy, Preston Burnett (the victim), and two others arrived at the house. At some point, Preston asked for a ride to Lakeland. Garst, Clardy, and Preston got in the Buick and drove down Skyview Boulevard and onto the cut-through which connects Skyview Boulevard to the Secret Cove subdivision.
  • Garst drove onto the grassy pathway then stopped. Clardy got out, opened Preston’s door, and told him to get out.
  • Clardy shot Preston Burnett multiple times and then dragged him a few feet off the path.
  • Garst told deputies he made two cell phone recordings of the murder-before and during the shooting.
  • He told detectives the gun used to kill Preston belonged to him (Garst).
  • He told detectives Clardy told him he was coming over and that he needed to “get rid of this guy” meaning Preston. A short time later, Clardy and Preston arrived at Garst’s residence on Skyline Drive West in Lakeland.

PCSO detectives retrieved the cell phone recordings of the murder. They show Preston standing on the passenger side of the car, and Clardy standing behind the car talking to Preston. Clardy can be heard saying, “I told you not to come back here,” and “I told you what was going to happen to you the next time you came back.” Shots can be heard on the video.

PCSO detectives recovered the firearm used in the homicide, and obtained an arrest warrant for Clardy. During the early morning hours of Friday, May 26, 2017, detectives located and arrested Clardy, and interviewed him.

Post-Miranda, Clardy initially told detectives that Garst killed Preston. Later, after listening to the audio from the cell phone recording, he made a full confession. He told detectives that he killed Preston because of the way Preston treated Clardy’s family.

Jamie Garst’s criminal history includes:

  • August 2010 – arrested by LPD for 2 counts aggravated battery with a deadly weapon
  • December 2013 – arrested by PCSO for robbery and VOP

Christopher Clardy’s criminal history includes:

  • July 1997 – arrested by PCSO for possession of short-barreled shotgun and money laundering
  • August 2010 – arrested by PCSO for aggravated assault with deadly weapon
  • November 2011 – arrested by PSO for possession of controlled substance without prescription, possession of marijuana, possession of paraphernalia
  • February 2012 – arrested by PCSO for FTA
  • April 2012 – arrested by PCSO for DWLSR, possession of drugs WITS, possession of paraphernalia, smuggling contraband into detention facility
  • August 2012 – arrested by PCSO for aggravated assault with deadly weapon, domestic battery, burglary, possession of burglary tools with intent to use, larceny grand theft, VOP
  • February 2013 – arrested by PCSO for petit theft, possession of controlled substance without prescription, possession of paraphernalia, burglary, VOP
  • March 2016 – arrested by HCSO for grand theft, fraud, dealing in stolen property

 

Winter Haven Man Arrested After Allegedly Stabbing Sister, Beating Family Members & Setting House On Fire

Winter Haven, Florida – On Tuesday around 3 p.m. Polk County Sheriff’s Deputies along with Polk County Fire Rescue arrived at 3505 Avenue T, NW. due to a fire on the back porch. The fire was contained to the porch and a shed. They fire was set on purpose according to witnesses.

According to reports 44-year-old, David Smith, went into a drug (reportedly K2) fueled rage and allegedly assaulted his girlfriend by punch her in the head. Smith allegedly punched his step-mother, who is currently treating for breast cancer, in the head also. During those altercations his sister tried to step in and she repeatedly had her head shoved into a wall and eventually was stabbed while trying to wrestle a knife away from Smith.

Smith was seen by witnesses dousing the porch with gasoline prior to the fire. Deputies were able to apprehend Smith.

Smith’s sister was taken to Lakeland Regional Health Medical Center and received multiple stitches.

Smith faces multiple charges including 4 counts of attempted felony murder, arson and aggravated assault. According to his booking sheet Smith is a suicide risk and a death by cop risk. He is a maximum custody in the Polk County Jail.

PCSO Deputies Again Arrest Kyle Barwan on Stolen Valor Charges

On April 28, 2017, PCSO deputies received information that 25-year-old Kyle Barwan of Lakeland, who was previously arrested and charged twice for stolen valor, again misrepresented himself as a military member to try to get money from a victim.

Barwan was originally arrested on January 25, 2017, in Hillsborough County on a PCSO warrant for stolen valor, and was later transferred to the Polk County Jail. While still in jail, on February 20th, he was additionally charged with Soliciting Funds/Misrepresenting Military Service (F-3) (see below previously sent releases).

He is now back in the Polk County Jail, being held on no bond, for:

  • Soliciting Funds/Misrepresenting Military Service (F-3)
  • VOP – Fraud (F-3)
  • VOP – Tampering with Witness – (F-2)
  • VOP – Soliciting Funds/Misrepresenting Military Service (F-3)

The following is an excerpt from his most recent affidavit, and is self-explanatory:

On 04/28/2017 PCSO deputies received information regarding the complaint of male portraying himself to be a member of the armed forces (Army Green Beret) and soliciting contributions to assist the homeless. 

According to the victim, on 04/26/2017 at approximately 0815 hours she was at Munn Park in downtown Lakeland when she was approached by Kyle Barwan. Barwan told her and another woman standing there that he was home from the military working with the homeless while he was on leave. He advised he was a member of the Green Beret and that he was getting redeployed for 18 months when he went back. When he asked for money to help the homeless, the other woman gave him some money. Barwan told her she could donate too. She stated she felt like she was being set up so she didn’t give Barwan any money. 

The victim located Barwan on Facebook and after locating other articles showing he had been arrested for impersonating military members, she posted one of the articles on his Facebook page. She stated Barwan then blocked her from his account. She felt that something should be done about Barwan continually doing this. She contacted local authorities. 

Probable cause exists that Kyle Barwan intentionally misrepresented himself as an active duty member of the United States Army while he solicited charitable funds from the witness. This in violation of Florida State Statute 812.312 which prohibits such actions and further advises anyone who violates this statue commits a felony of the third degree. 

Contact was made with Probation Officer Pennington who advised she was assigned Kyle Barwan. Deputies further learned PO Pennington had recently received two other complaints regarding Barwan doing the same activity. Pennington recovered written statements regarding both incidents, one of which was already reported to the Lakeland Police Dept. 17-8918.

Kyle C Barwan was on felony probation at the time of this incident. Barwan’s probation began on 04/13/2017 and was set to conclude on 04/12/2022. His probation case number is 17-0732. Barwan is also being charged with a violating his probation. Part of Barwan’s probation is regarding a similar incident.

 

TWO PREVIOUSLY SENT RELEASES:

 

On Friday, February 17, 2017, PCSO deputies filed additional charges of Soliciting Funds/Misrepresenting Military Service (F-3), and Tampering With A Witness, against Polk County Jail inmate Kyle Barwan after a second victim came forward.

Barwan was originally arrested on January 25, 2017, in Hillsborough County on a PCSO warrant, and was later transferred to the Polk County Jail, where he has remained since that time. After seeing news reports about Barwan’s arrest and learning that he was in jail, another female victim came forward.

If anyone else believes they have been victimized by Kyle Barwan, they are encouraged to contact PCSO at 863-298-6200. With his two additional charges, he remains in the Polk County Jail in lieu of $7,000 bond ($5,000 for the first count of Soliciting Funds, and $1,000 each additional count filed on Friday).

The following is an excerpt from his most recent affidavit, and is self-explanatory:

Sometime during late September 2016, the female victim met the suspect, Kyle Barwan, on an online social networking site known as Plenty of Fish. The two online chatted and then met in person on a date. Barwan told the victim that he was in the United States Army Special Forces as a Green Beret.

Barwan told her that he had just been promoted to the rank of Captain. She noticed that Barwan was wearing a “special forces hat with a flag on it.” Barwan told her that he had a military identification card but he did not show her one. Barwan went on to say that he also works for the CIA as a paid mercenary and that he had several “hits” in the Lakeland area. Barwan told the victim that he had been deployed to Afghanistan and Germany and he spoke other languages. The victim stated she was 100 percent convinced that Barwan was an actual military officer. 

Barwan began asking the victim for money to help pay his phone bill, rent, and for food. She stated she gave Barwan approximately $150-$200 to help him out, still under the impression that he was a military officer. Barwan then asked for $60 to buy an online Microsoft program that he needed for his assignment in the military. The victim took Barwan to the GameStop in Lakeland and gave him $60 for the online program to help him with his duties in the military. 

The victim stopped talking to Barwan near the end of October 2016 as she felt he was lying to her. Barwan continued to call and text her, which she ignored. One day, Barwan sent the victim a text message stating; “Fine don’t want to answer than I’m going to your house” followed by another message that read, “See you there.” The victim replied to Barwan’s text “Stay the [expletive] away from my house.” Barwan then replied with a winking face emoji and “You’ll do what? Call the police ha lol good luck with that you’ll find out that im way too connected” followed by another message stating “See you soon.”

The victim told deputies she wanted to contact Law Enforcement because she was scared of Barwan’s intimidation.  She stated because Barwan stated he was “connected” it placed her in fear of retaliation. She contacted Law Enforcement on 02/15/2017 after learning that Barwan was in jail.

Deputies obtained Barwan’s Report of Separation and Record of Service from the Army National Guard of Kentucky. Barwan enlisted in the Army National Guard of Kentucky on 03/20/2007 and was discharged on 01/22/2008 at the rank of Private 2nd Class, which is the first promotion most enlisted Soldiers can earn after completing basic combat training. Barwan was discharged for failure to meet medical procurement standards and his character of service is listed as “uncharacterized.” An uncharacterized discharge from the military is an entry-level separation issued when the enlisted person has fewer than 180 days of service. Deputies completed a Request Pertaining to Military Records, SF180, and sent it to the National Personnel Records Center. Deputies received a response stating no other Military records were located. These records prove that Barwan is no longer affiliated with the Army/Army National Guard, is not an Officer, was never deployed, and was never injured in the line of duty. 

Barwan violated F.S.S. 817.312 by misrepresenting himself as a member of the United States Army while soliciting and obtaining charitable contributions from the victim. PCSO previously arrested Barwan on 01/25/2017 for the same charge with a different victim. 

Barwan violated F.S.S. 914.22(E) by knowingly intimating the victim in an effort to hinder her from contacting Law Enforcement. 

 

ORIGINAL NEWS RELEASE SENT ON 01-26-2017: On Wednesday, January 25, 2017, PCSO deputies obtained an arrest warrant for 27-year-old Kyle Christopher Barwan of Glen Road in Lakeland for Soliciting Funds/Misrepresenting Military Service (F-3).

FSS 817.312 – Unlawful use of uniforms, medals, or insignia.- (1) A person may not misrepresent himself or herself as a member or veteran of the military or wear the uniform of or any medal or insignia authorized for use by members or veterans of the military which he or she is not authorized to wear while soliciting for charitable contributions or for the purpose of material gain.

In December 2016, PCSO received a tip from someone who read a blog about Barwan impersonating military officers. During the investigation, deputies learned Barwan has previously been arrested and charged federally for impersonating an officer in the military, in two different states (Kentucky and Illinois). Barwan befriended a Polk County woman online, and told her many lies about his military service while also soliciting money from her “to benefit one of his fellow soldiers who was injured in the war.”

Barwan was taken into custody in Plant City on January 25th, and booked into the Hillsborough County Jail on the Polk County warrant. He will be transferred to the Polk County Jail at a later time.

Lake Wales, FL – The General Surgery office of Lake Wales Medical Group held a Ribbon Cutting ceremony recently at its new location, 407 S. 11th St. in Lake Wales. Staff and administrators from the hospital, Lake Wales Medical Group, and the Greater Lake Wales Chamber of Commerce were in attendance.

The new General Surgery office space is home to general surgeons Dr. Fred Silvestri and Dr. Fred Howard, and Gastroenterologist Dr. E. Moshe Izsak, all of whom are members of the medical staff at Lake Wales Medical Center.

“This new office space allows us to bring the talents of all three of these surgeons together in one place to see patients in a location that’s close to the hospital,” said Greg Hall, Director of Physician Practices for the hospital. “It’s a nice modern office space that allows us to deliver enhanced services to our patients.”

LAKELAND, FL (May 25, 2017) – The Lakeland Police Department is investigating a Missing Endangered Adult from 311 East Memorial Boulevard. Mr. Grady Lamarr Palmer, 76 years old was last seen on May 24, 2017 at approximately 7:30 p.m. driving a green Ford Explorer bearing Florida tag 193-OKB. He was wearing  green khaki pants, a beige button shirt, a navy blue golf cap, and black dress shoes. He is 5′ 8″ and 150 lbs. Mr. Palmer suffers from dementia and has not returned to his place of residence.

“Top Gun 2” Movie Confirmed By Tom Cruise

Tom Cruise turned up the excitement around the production of “Top Gun 2” on Wednesday with a confirmation on Australian TV that the film will go ahead.

Interviewed on the “Sunrise” show on Australia’s Seven Network, Cruise said that “filming will begin probably within the next next year.”

Asked by the presenter if rumors of the long awaited sequel were correct, Cruise said “its true,” before breaking into cackles and repeating himself several more time. “Its happening,” he added. “You’re the first people I’ve told. It’s going to happen.”

  1. Preheat oven to 375 degrees F (190 degrees C).
  2. Place a steamer insert into a saucepan, and fill with water to just below the bottom of the steamer. Cover pan and bring the water to a boil. Place 1 pound of asparagus into the steamer insert, cover, and steam until just tender, 4 to 6 minutes. Drain asparagus and set aside.
  3. Beat eggs, half-and-half, parsley, salt, white pepper, and green hot sauce in a bowl until smooth.
  4. Stir together cooked chicken, Swiss cheese, Monterey Jack cheese, mushrooms, and green onions in a bowl; mix in flour.
  5. Line a 9-inch pie dish with pie crust.
  6. Spread about half of the cooked asparagus over the bottom of the crust.
  7. Spread about half of the chicken mixture over the asparagus.
  8. Repeat layers of asparagus and chicken mixture.
  9. Gently pour the egg mixture over the layers.
  10. Arrange 3 asparagus spears decoratively on top of the quiche.
  11. Bake in the preheated oven until the filling is slightly puffed and lightly browned and a toothpick inserted into the center of the quiche comes out clean, 40 to 50 minutes.
  12. Sprinkle quiche with cherry tomatoes, if desired.
