 Police Press Release

On Thursday August 10, 2017, Lake Wales Police Detectives began an investigation revolving around allegations that 53 year old Michael Holt had recently attempted to molest a 10 year old little girl.  Holt resides at 511 S 9th Street and is not related to the victim.

During the investigation, detectives learned Holt, while nude, attempted to coerce the child to touch his penis. The child refused and eventually left the residence. On Friday August 11, 2017, detectives located and arrested Holt at his residence.

During an interview after his arrest, Holt claimed he was ashamed of what he did and called his actions “stupid”. He did admit attempting to get the child to touch his penis while he masturbated. He also admitted this occurred on one other occasion.  Holt said he had a problem and was glad detectives had arrested him.

Detectives charged Holt with two counts of lewd or lascivious exhibition, a second degree felony. He was transported to the Polk County jail.

This is a very serious crime and detectives would like to identify if there are any other possible victims.  Please contact Detective Jonathan Fletcher at 678-4223 ext. 590 with any information. If you wish to remain anonymous, you can contact Heartland Crime Stoppers at 1-800-226-TIPS (8477).

Deputies arrest juvenile and adult for car burglaries in the un-incorporated Winter Haven area

PCSO Press Release:

Polk County Sheriff's Office General Crimes Unit detectives arrested 20-year-old Devon Toothman of Auburndale for armed burglary, grand theft, and conspiracy to commit a conveyance burglary, and 17-year-old Richard Kroeger of Lake Wales for armed burglary, grand theft of a firearm, conspiracy to commit conveyance burglary, possession of tools to commit burglary, and dealing in stolen property, on Saturday, August 12, 2017, at approximately 2:08 a.m. A citizen in the Marianna Acres neighborhood saw Toothman and Kroeger breaking into his vehicle. He honked his horn at them and they ran from his home. He called deputies immediately and gave them a description.

PCSO deputies responded and caught the pair shortly thereafter.

According to the affidavits, Toothman and Kroeger told deputies they planned in advance to break into cars together. They admitted to entering multiple unlocked vehicles in the area of Cypress Shores Community and in the area of Oak Drive and Lake Marianna Drive.  During the course of the burglaries Kroeger stole a fully-loaded Glock27 from the center console of a truck, and held onto it while they committed other burglaries. Kroeger told deputies he was going to try and sell the firearm.

Kroeger was wearing a red bandanna to conceal his identity and rubber gloves to prevent fingerprint detection. Kroeger and Toothman stole a firearm, cash, cell phone cables and chargers, medical equipment, lighters, and cigarettes.

"We are constantly asking the public, when you see something, say something. We want to commend this alert citizen who saw something, and said something. Without him, we would not have captured these suspects so quickly. This is another example of one man who committed multiple crimes as a juvenile, who was released, and is still committing crimes. This other juvenile is not being held accountable for his crimes, and is still on the street committing crime and victimizing multiple people." – Grady Judd, Sheriff

Fatal Traffic Crash Investigation

On August 11, 2017, at approximately 8:35 pm, the Haines City Police Department investigated a fatal crash on Hwy 27, near Hwy 17/92.

The preliminary investigation has revealed 18 year old Jason Navarro, of Haines City, was travelling southbound in a Nissan 350Z when he apparently lost control of the vehicle. The Nissan appeared to have spun out of control, went across the median striking several crape myrtle trees before entering the northbound lanes of Hwy 27.

Upon entering the northbound lanes, the Nissan was struck by an Acura MDX driven by 47 year old Mario Rodriguez from Miami. Haines City and Polk County Fire Rescue arrived on scene and had to subsequently extricate Navarro from his vehicle. Navarro was wearing his seatbelt at the time. He was subsequently transported to the Heart of Florida Hospital in which ultimately succumbed to his injuries.
Weather may have been a factor in this crash as the roads were wet and it was raining moderately.
Jason attended Ridge Community High School in Haines City.

Our thoughts and prayers are with Jason’s family and classmates during this time of tragedy.
The investigation is in its preliminary stages, and the cause of the crash has not been determined.

LWMC EMPLOYEES DONATE BACKPACKS FOR LOCAL STUDENTS

Lake Wales, FL – Nearly 100 Lake Wales area school students will be starting the school year with new backpacks stuffed with lots of new school supplies, thanks to the employees at Lake Wales Medical Center.

The hospital held a backpack drive this summer to gather school supplies and backpacks.

“Our employees enjoy a little friendly competition among departments, so we issued a challenge and offered prizes for the department that donated the most backpacks, and for those with the most creative displays,” said hospital CEO Rebecca Brewer. “As always, they came through with lots of donations and lots of creativity.”

In addition to the nearly 100 backpacks, hospital employees donated school supplies, such as paper, pencils, pens, rulers, glue, erasers, crayons, and more. The backpacks are being distributed through local area schools.

The winner of the most backpacks donated – for the 2nd year in a row – was the Rehabilitation department, with 23 stuffed backpacks.

Most creative display was a tie between Engineering’s Wizard of Oz theme, and Laboratory’s Minions theme.

The entries were judged by Paula Alford and Marie Cherington from Lake Wales Charter Schools.

“We like to have fun with this, but the real point is to help the children in our community,” Brewer said. “Education is essential to success, and we’re proud to be able to help equip local students to be successful in school.”

Couple Charged With Falsifying Document on PCSO Letterhead

PCSO PRESS RELEASE:

PCSO deputies have charged a Polk County Jail inmate with criminal use of personal identification, and issued a warrant for his girlfriend’s arrest for the same, after a business in Plant City (Reddy Ice) received what appeared to be a letter from PCSO on PCSO letterhead, in an attempt to retain the inmate’s employment.

Inmate Marco Sullivan, DOB 5/30/85, was arrested on July 24, 2017, by LPD for DWLSR, resisting arrest, fleeing to elude, and an Orange County warrant. He is being held on no bond for the out-of-county warrant. His girlfriend, Martisha Wilson, DOB 7/20/71, also has an Orange County warrant for her arrest.

The couple came up with an idea to create a fake letter, on PCSO letterhead, and send it to Sullvan’s employer, Reddy Ice, so that he could keep his job while absent. The letter appears below.

“You can’t make this stuff up! Here’s a bit of advice – if you’re going to try to dupe someone into thinking you’re working with law enforcement, you should probably use a real name (we don’t have anyone here named Mike Singleton) and maybe not have misspelled words. And by the way, fabricating a letter from the Sheriff is against the law.” – Grady Judd, Sheriff

The following is an excerpt from their affidavits, and is self-explanatory:

On 08-03-2017, a Reddy Ice representative contacted the Polk County Sheriff’s Office to verify a letter that had been sent to their company by an employee’s girlfriend. The letter was typed on letterhead displaying the name of Sheriff Grady Judd. The letter is signed by hand with the name of Mike Singleton.

It is indicated in the letter that Marco Sullivan (employee of Reddy Ice) is doing a special detail which is confidential for the Polk County Sheriff’s Office ATF Investigation Unit. The letter stated Sullivan will be working with the unit for 6 months or less and “do to the severity of the case” they cannot “enclose any farther information”. (Any typographical or grammatical errors noted are as typed in the letter). A telephone number of 863-855-4150 is listed in the letter for the recipient to read if there are any concerns. The letter is signed “Sincerely, Mike Singleton.”

Contact was made with a Reddy Ice supervisor who is Sullivan’s supervisor. He advised that on 07-24-2017 he received a text message from 863-399-3520 from someone posing as Sullivan and advising Sataros that he was unable to report to work due to having the flu. He advised he received a telephone call on 07/27/17 from telephone number 863-399-3520 and the female caller who identified herself as Sullivan’s girlfriend advised him that Sullivan had signed up to work with the police. He advised he has met Sullivan’s girlfriend several times at Reddy Ice and Sullivan introduced her as his girlfriend, Shanell. I showed the supervisor a photograph of Martisha Wilson and without hesitation he advised that is the same person Sullivan introduced as his girlfriend.

The supervisor advised he told Wilson that he will need a letter from the agent stating Sullivan is working with them. He advised her he would need the “agent” to send him a letter in order to keep Sullivan employed at Reddy Ice. He advised he received the letter on 8-2-2017 via e-mail. The Polk County Sheriff’s Office verified this letter did not come from the law enforcement agency and Marco Sullivan is not being used as a confidential informant. Additionally, an employee with the name of Mike Singleton is not and has not been employed with the Polk County Sheriff’s Office.

Polk County Sheriff’s detectives entered Marco Sullivan’s information into the Polk County Sheriff’s Office database and determined Sullivan has been incarcerated since 07/24/17 at the South County Jail for unrelated Lakeland Police Department charges. Detectives responded to the South County Jail and made contact with Sullivan. They conducted an interview during which Sullivan admitted telling his girlfriend, “Lisa Wilson” he needed to give his employer, Reddy Ice, a fraudulent letter in order to keep his employment. Sullivan was shown the letter and admitted it was fraudulent. He stated he did not instruct Wilson to use PCSO letterhead or come up with the name Mike Singleton. He does not know where the letterhead came from or the name Mike Singleton.

Detectives determined the telephone number 863-399-3520 belonged to Martisha Wilson. On 08-4-2017 Martisha Wilson’s information was entered into NCIC/FCIC which revealed an active warrant out of Orange County for FTA -Theft (2nd prior conviction). The warrant was entered 02-02-2016 and the warrant number is W285488492. Attempts are made to locate Martisha Wilson with negative results.

In-person contact was made with Sullivan. After Miranda via agency-issued Miranda card, Sullivan advised he was not telling on the person who wrote the letter. Sullivan advised they were just trying to help him keep his job. Sullivan stated, “If you want to charge someone, charge me. It was my idea. I will take all the charges.” Sullivan advised he did not think the letter was a big deal and refused to advise who wrote it.

Martisha Wilson willfully and without authorization possessed the personal name of Grady Judd with the intent to fraudulently use without permission. Martisha Wilson discussed the details of Marco Sullivan’s arrest on 07/24/17 with Sullivan. Due to their lengthy relationship, Martisha Wilson knew or should have known that Marco Sullivan was not employed for or working with law enforcement. Multiple conversations were held between Martisha Wilson and Sullivan clearly indicating she knows the letter exists to include her reading the letter to Sullivan and by doing such, she has engaged in deception with the intent to defraud.

“Here are three juveniles, wreaking havoc throughout Bartow, breaking into cars, including a marked Sheriff’s vehicle, and stealing a car, the day before school starts in Polk County. These kids are not afraid of our current juvenile justice system. The juvenile justice system is failing our kids, our victims, our state, and our community. These kids need to be held accountable for their outrageous criminal conduct, and treated like the juvenile criminals they are. Our community and our state deserve to be protected by them.” – Grady Judd, Sheriff

According to their affidavits, on August 9, 2017, multiple conveyance burglaries were reported in Bartow, having been committed during the late evening/early morning hours of August 8th through 9th, including a marked PCSO Agricultural Crimes pickup truck. The suspect(s) broke into the truck and through the locks securing the firearms in the truck, and also stole a ballistic vest, Oakley sunglasses, an iPhone, an Android tablet, and other personal items.

A stolen vehicle, described as a 2015 gray Ford Fusion, was also reported to Bartow Police under BPD case #17-2544. The vehicle was last seen on around 8:00 p.m. on August 8th, and discovered missing around 7:20 a.m. on August 9th.

The following is an excerpt from the affidavits, and is self-explanatory:

Video surveillance was located and showed what appeared to be a tall, thin male, running and being paced by a medium colored Ford Fusion. The Ford Fusion backs out of camera view, then shortly after drives forward again, away from the scene.

On 8-9-17 around 1245 hours, PCSO detectives located the stolen Ford Fusion at the dead end of Summerlin Oaks Apartments, located at 980 Church St East, Bartow.

Deputies maintained surveillance of the vehicle, and at approximately 1724 hours, deputies observed a subject begin to open the door to enter the vehicle. The subject apparently saw the deputies and began fleeing through the apartment complex. Deputies chased the suspect on foot and set a perimeter immediately. Deputies located the stolen PCSO handgun, wrapped in a shirt, on the path of the foot pursuit.

K9 tracked the suspect to the area of the Polk County School Board.

The suspect was located in the crawlspace of a Polk County School Board building at 1430 Hwy 60 East, Bartow, at 2038 hours. The suspect identified himself as Malik Smith, B-M, 9-24-01. Deputies verified the identity by prior interactions. The suspect was interviewed, and post-Miranda he stated he did take the vehicle overnight, and later parked it in the back of the apartment complex to hide it and use it later.

He described that he had taken the firearms together with a subject he knows as “Deuce,” a Puerto Rican male, who lives at a duplex with a silver car out front, on Gay Street, in Bartow.

He stated he drove with Deuce to the Gay Street residence and dropped off the items in the back yard. They left the items in the back yard and drove around for a while, before returning to the house in the early morning hours. He stated he took possession of one handgun, and Deuce took the rest of the firearms and property into the residence. He stated he did not know where his handgun went, but the rest of the firearms would be located at Deuce’s residence.

PCSO detectives made contact with Joshua Allen Deus, at 1010 East Gay Street, Bartow, and conducted a security sweep to secure the residence for a search warrant. They observed an open trash bag in plain sight in the back yard with shotgun and handgun ammunition matching the style issued by PCSO. The discovery was consistent with Malik Smith’s statements.

Deputies executed a search warrant at approximately 0214 hours.

The other stolen firearms were all located during the search warrant. A black bag containing multiple small bags of cannabis, and two scales, was located in the kitchen refrigerator. Personal items for Joshua Deus, including an ID card, were located in the backpack, together with the firearms.

Joshua Deus and Juan Deus were both interviewed.

Post-Miranda, Joshua Deus stated he did take possession of the weapons from Malik Smith. He advised he helped move and conceal the firearms inside the residence. He did not admit to being present during the initial theft. He admitted to possession of the cannabis in the refrigerator.

Post-Miranda, Juan Deus also stated he took possession of firearms from Malik Smith and moved them in the residence. He did not admit to being involved in the initial theft.

Based on the suspects’ statement, video surveillance, and evidence located, probable cause exists to believe all three of the suspects committed armed burglary of a PCSO vehicle, along with grand theft of a firearm (4 counts), criminal mischief (damage) to the inside of the vehicle, and grand theft. Further they committed motor vehicle theft and armed burglary regarding the theft of the 2015 Ford Fusion, in which they transported the firearms.

ADDITIONAL CHARGES FOR SMITH: Additionally, he committed resisting without violence and tampering with evidence when he intentionally fled from law enforcement and discarded a firearm of evidentiary value, concealed in a shirt. Further, he committed trespassing on school property and burglary of a structure, when he entered into the gated compound of the Polk County School Board property, and then into the crawl space of the School Board building. He committed violation of injunction as he has an active injunction for protection, served and valid from 4-12-16 through 4-12-20. The injunction is Hillsborough County case #16-10540. The injunction orders no possession of weapons or firearms. Further, he committed a minor in possession of a firearm and unlawful possession of concealed firearm. Deputies confirmed through JAC that Malik Smith is on active probation as of 5-23-17 for grand theft and burglary.
