DNA Evidence Leads To Arrest Of A Mulberry Man For Sexual Battery

Mulberry, Florida – The Polk County Sheriff’s Office has arrested and charged a Mulberry Florida man, Diego Bellido ( DOB: 08/05/1984), with sexual battery. According to a Polk County Sheriff’s Office arrest affidavit DNA evidence from an incident in May of 2021 lead to the arrest.

The following is a long excerpt from the Polk County Sheriff’s Office affidavit (It should be noted that this is an unedited report of facts by the Polk County Sheriff’s Office . These facts are up for question and everyone is entitled to question the validity of facts by law enforcement in a court of law. The Daily Ridge does not rewrite these facts as some meanings or interpretations could be in error and change context. We hope readers appreciate being able to read the information and come to their own understanding and conclusions):

“On 5/6/21, D/S Herrera (#7023) responded to an apartment on NW Avenue in Mulberry where he made contact with the reportee/victim (REDACTED), During the investigation, REDACTED made allegations of sexual battery against the suspect (Diego Bellido). REDACTED advised that the suspect is a neighbor, and he forced his way into her apartment and sodomized her.

Detective Fitzgerald (#6053) responded to the scene and made contact with REDACTED who agreed to have a marked patrol unit transport her to Lakeland Regional where she allowed hospital staff to conduct oral and fingernail swabbings. The swabbings were later forwarded to FDLE for analysis.

During an interview with the suspect, he denied having any type of sexual intercourse with the victim. Det Fitzgerald requested buccal swabs, but the suspect refused consent. The suspect later obtained legal counsel, who advised he (suspect) would not be answering any other questions from law enforcement, nor would he consent to any swabbings or a polygraph examination.

On 8/27/21, FDLE completed their report in regards to this investigation. Item 1.1 (light blue underwear) demonstrated a mixture consistent with two donors. FDLE requested buccal swabs from the suspect.

On 9/10/21, Det. Fitzgerald authored a search warrant for the suspectts buccal swabs, which was approved by ASA J, Orr, and signed by the Honorable Judge Barber.

On 9/14/21, Det Fitzgerald sewed the search warrant and obtained buccal swabs from the suspect. The buccal swabs were forwarded to FDLE for analysis.

On 12/20/21 FDLE completed their report. The report reads, “Diego Bellido is included as a possible contributor to the mixed DNA profile obtained from item 1.1 (Stain B cutting 1from underwear). The observed mixed DNA profile is greater than 700 billion times more likely to have originatedfrom REDACTED and Diego Bellido than from REDACTED and an unrelated individuaL

The foreign DNA profile obtained from Item 1.1 (Stain B coming from underwear) matches the DNA profile from Diego Bellido (item 3).

The observed foreign DNA profile is greater than 700 billion dmes more likely to occur if the sample originated from Diego Bellido,

Due to the allegation made by the victim, the statement made by the suspect that he had not engaged in any sexual acts with the victim, and the FDLE report that contradicts the suspect’s statement, I have determined sufficient probable cause exists to believe the suspect violated F,S.S. 794.011 (5)(b) sexual battery by adult on adult when he sodomized the victim against her will.

On 1/3/21, I responded to the suspect’s residence where he was taken into custody and transported to the Sheriffs Processing Center without incident.”
